1. Acceptance of Terms
These Terms of Service ("Terms") form a legally binding agreement between you and Janmat Technologies Private Limited ("Janmat", "we", "us", or "our"), governing your access to and use of the Janmat mobile application and website (collectively, the "Service").
By creating an account, downloading the app, or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, do not use the Service.
2. Eligibility
To use Janmat, you must:
- Be at least 18 years of age.
- Be a resident of India with a valid Indian mobile phone number.
- Have the legal capacity to enter into a binding agreement.
- Not have been previously banned from the Service by us.
By using the Service, you represent and warrant that you meet all of the above requirements.
3. Your Account
3.1 Registration
You register by verifying your mobile phone number via a one-time password (OTP). One account is permitted per phone number. You must not create multiple accounts or share your account with others.
3.2 Account security
Your account is secured by Firebase Authentication. You are responsible for any activity that occurs under your account. Notify us immediately at support@janmat.ai if you suspect unauthorised access.
3.3 Accurate information
You agree to provide accurate and complete profile information (state, age range, gender, education, occupation) and to keep it reasonably up to date. Providing false demographic information to manipulate poll targeting is a violation of these Terms.
3.4 Account deletion
You may delete your account at any time via Settings in the app or at janmat.in/delete-account. Account deletion is subject to our Data Retention Policy. Ripple balances are non-transferable and are forfeited upon deletion.
4. The Service
4.1 Nature of the Service
Janmat is a civic-opinion platform. Questions published on the platform represent matters of public interest; they are not referendums, elections, or binding instruments of any kind. Janmat poll results are indicative only and do not constitute official public policy data.
4.2 Availability
We strive for high availability but do not guarantee uninterrupted access. We may perform scheduled or emergency maintenance without prior notice. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
4.3 Offline functionality
The app may offer limited offline functionality. Data cached locally on your device remains subject to these Terms.
4.4 Third-party services
The Service uses Google Firebase (auth, database, storage) and Google Cloud. Your use of these underlying services is also subject to Google's applicable terms of service.
5. Ripples & Rewards
5.1 What are Ripples?
Ripples are a non-monetary, in-app credit unit used to measure engagement and unlock platform features. Ripples have no cash value, are not a financial instrument, and cannot be exchanged for money, goods, or services outside the Janmat platform.
5.2 How Ripples are earned and spent
- Sign-up: +10 Ripples on account creation.
- Profile completion: +100 Ripples on completing your profile.
- Voting: +10 Ripples per vote cast.
- Changing a vote: −5 Ripples per change.
- Referral bonuses: additional Ripples when referred users take qualifying actions (amounts displayed in-app).
5.3 Ripple ledger
Every Ripple credit and debit is recorded in an immutable activity log stored on your account. This ledger is retained even after account deletion to maintain the integrity of referral accounting.
5.4 No guarantee of future value
We may adjust the Ripple economy (earning rates, redemption tiers, feature unlocks) at any time with 15 days' notice. Ripple balances will be honoured under any new scheme or converted at a rate we determine in good faith. In the event of platform shutdown, Ripple balances will be forfeited with no compensation.
Ripples are not money. Any attempt to sell, transfer, purchase, or exchange Ripples for real-world currency or value — including via third-party platforms — is strictly prohibited and will result in immediate account termination.
6. Prohibited Conduct
You agree not to:
- Create multiple accounts to inflate vote counts or Ripple balances (vote farming).
- Use bots, scripts, automation, or any artificial means to interact with the Service.
- Attempt to reverse-engineer, decompile, or extract the source code of the app.
- Interfere with or disrupt the Service or its underlying infrastructure.
- Provide false profile information to deliberately skew poll targeting.
- Impersonate another person or entity, or misrepresent your affiliation.
- Use the Service for any unlawful purpose, including in violation of the Information Technology Act, 2000, or any other applicable Indian law.
- Attempt to access another user's account or data.
- Submit, transmit, or promote content that is defamatory, obscene, hateful, or that violates any law.
- Commercially exploit any part of the Service without our written consent.
Violation of any of the above may result in immediate account suspension or termination (see §8).
7. Content & Intellectual Property
7.1 Our content
All questions, audio, graphics, branding, software, and other content on Janmat (excluding your responses) are owned by or licensed to Janmat Technologies Private Limited and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
7.2 Your responses
When you vote or submit a change reason, you grant Janmat a worldwide, royalty-free, perpetual, irrevocable licence to use your anonymised response in aggregate analyses, reports, and products. Your individual answers are never attributed to you publicly.
7.3 Feedback
Any feedback, suggestions, or ideas you submit to us become our property. We are not obligated to implement or compensate you for any feedback.
8. Suspension & Termination
8.1 By us
We may suspend or terminate your account, with or without notice, if we determine that you have:
- Violated any of these Terms.
- Engaged in conduct harmful to other users, the platform, or third parties.
- Provided false registration information.
We will attempt to notify you by in-app message before termination except where immediate action is necessary to prevent harm or comply with law.
8.2 By you
You may terminate your account at any time. Termination is irrevocable. Ripple balances are forfeited. Data handling post-termination is governed by our Privacy Policy (§6).
8.3 Effect of termination
Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive (intellectual property, disclaimer, limitation of liability, governing law) will continue to apply.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be available at all times or be error-free.
- Poll results are statistically representative of the Indian population.
- Any Ripple earning opportunity will continue indefinitely.
- The Service is free of viruses or other harmful components (though we take reasonable precautions).
Poll results on Janmat are user-generated opinion data. They are not scientific surveys, election polls, or official government data. Do not rely on them for decision-making.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JANMAT TECHNOLOGIES PRIVATE LIMITED AND ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.
In any event, our total aggregate liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed ₹1,000 (Indian Rupees one thousand).
Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded under applicable Indian law.
11. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.
Dispute resolution: Any dispute, controversy, or claim arising out of or relating to these Terms shall first be attempted to be resolved amicably through good-faith negotiation. If unresolved within 30 days, the dispute shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by mutual agreement. The seat of arbitration shall be Bengaluru, Karnataka, India, and proceedings shall be in English.
Nothing in this clause prevents either party from seeking emergency injunctive relief before a competent court.
12. Changes to These Terms
We may modify these Terms at any time. Material changes will be communicated via in-app notification at least 15 days before they take effect. The "Last updated" date at the top of this page will be revised accordingly.
Continued use of the Service after the effective date of revised Terms constitutes your acceptance. If you do not accept the revised Terms, you must stop using the Service and delete your account before the effective date.
